Hi everyone, I hope you are all doing great. I am just about to send my application away however have a few questions I have been unable to find answers for. I am a Canadian citizen living in Australia sponsoring my common law partner who also lives with me in Australia. We are moving back to Canada in the new year and have a daughter together who is also a Canadian citizen.
1.do I need photos of myself and daughter as well as partner?
2. Is there a certain form for stat decs (I see I need 2, however I am unsure of the layout and can only assume it's a letter supporting our relationship and signed by a notary?)
3. Does CIC contact you via mail or email. I have requested email as we will have no address as of November.
4.will my partner be able to work in Canada when we arrive or do I need to apply for a work visa once we arrive in Canada while the pr is being processed? I wasn't sure if a temp visa would be firstly given and if so is it relatively soon after applying.

I appreciate any assistance with my questions.

Only the principal applicant needs to submit photos in your case, since the sponsor and child are already Canadian.

CIC will contact you by e-mail if you include one.

Applying outland does not give you any right to work in Canada. They would need to get an approved LMIA in order to apply for a work permit.

1. No, you and your daughter don't need photos.

2. No, there isn't a certain form. The people writing them should state how they know you guys, that they know you are in a genuine and continuing relationship and how long you have lived together.

3. If you provide an email address, they will email you.

4. If you guys come to Canada before his app is approved, he will enter as a visitor and be unable to work. Once the app is approved, he would need to flagpole at the Canada-US border to land as a PR. If the app is approved before you come to Canada, he will land as a PR when he enters; he will be able to work as soon as he gets a SIN.

Is temporary residence granted sometime into the application before PR? Or do you just go straight to PR after the processing is complete?
Also with statutory declarations, I have some from about a year ago that are on an Australian stat form (these are notorised along with copies of the authors Identification, would this be acceptable?
I also see there is a separate stat ev form to be filled out and notorised to confirm common law however wanted to check if this was only for the purpose of having a co signer.

As I said, if he comes before his app is approved, he will enter as a visitor. When the app is approved, he needs to actually land as a PR; if he is in Canada, he will have to leave and re-enter or to make an appointment at an inland office to land (which can take months).

I would get new Stat Decs. One year is a bit old.

The Stat Dec of Common-law is not required.
 
The Statutory Declaration of Common-Law Union is not required, but some visa officers want to see it anyway. If they request it later, it delays the processing, so I would include it in the application. If the visa officer doesn't want it, it won't hurt to have included it.
 
Although it's usually best for Australians to apply outland, as of late, we have seen inland Asutralian applications approved before they even issue the work permit (about 3 months).

Of course that doesn't necessarily mean your case would be evaluated that quickly.
