What is your source for that?

AFAIK, Canada immigration doesn't waive the required one full year of cohabiting even if the couple has a child together. It would, however, eliminate the Conditon:51 for an applicant that was not Common-Law for more than 2 years with his/her sponsor (meaning have lived together for 3 years or more) at the time that CIC receives the sponsorship application.

Having a child together only makes you common-law for CRA tax purposes. That has absolutely nothing to do with CIC or immigration, in which the only way to common-law is 12 months of cohabitation regardless of any children together.

Huh. TIL.

Choice of whether to leave or stay is up to you. I'm not sure there's a right answer.

And as I mentioned, this is the family class sponsorship section of the forum so not many will know about NOC codes and things like that. You should post this question to the CEC or appropriate section of this forum to get more responses.

You need to spend more time familiarizing yourself with the rules of the Express Entry program. There is no longer an occupation list. An LMIA is not required but significantly increases your changes of being selected under Express Entry. Again, I would recommend you spend more time on the CIC site reading through the requirements for the program. The questions you are asking are extremely basic.
