Hello everyone. This is in behalf of my friend. Is there anybody here who has been out of status for years and now applying for sponsorship. Did you declare your work under the table on the application or is it best to not mention it at all? Thanks

What, like lie on their application? Your "friend" must declare what they have been doing. If they lie about working then they risk being refused for misrepresentation and face being banned.

Your friend if honest will need to declare in any application where they have been for a number of years prior to the application so there really is no way around having stayed and worked illegally without misrepresentation .

He already stopped working long time ago and there was no record of salary or anything because he was paid under the table. He also doesnt have a bank account. He is worried that if he mentions it, it will go against him and his application for spousal sponsorship.

Will they contact the employer if he declare it? He already stopped working long time ago but he’s worried that if he declare it, it will go against him and his application.

Illegal work is not a reason for refusal.

However, lying on the app IS a reason for refusal and if caught, he will end up with a 5 year ban for misrepresentation.
