Hi everyone.

I am currently out of status since May 2019 and applying for common law sponsorship in a month or so. I have been living with my partner since February 2018 and officially became common law on January 31, 2019. We weren't aware of the whole common law situation until recently and when he filed his taxes in April 2019 he declared himself as single for tax purposes and same when he applied in April 2020. We made a genuine mistake. How can we fix it?

Also i have not done my taxes for the past 2 years as I'm out of status and i did not work anywhere since i got out of status so how do we go about that? we are a little worried as i am out of status and what if the accountant report me or something while we get my partners tax situation fixed?

Please advice.

thank you

Your partner must refile their taxes. There may be some adjustment to their taxes and they may either owe or receive money. You must also file taxes for the period where you had status.

I got my pgwp rejected on January 22, 2019 and i applied for restoration as a visitor which was rejected in may 2019. i am assuming i had implied status till i got an answer for my PGWP which was January 22, 2019. correct me if I'm wrong. so i think i can apply for 2018 taxes but what about the 2019 taxes? should i apply for it as well or there is no need.

As for my partners tax return, i have a few question?
we started living together stating Feb 01, 2018 and became common law on january 31, 2019. so does he have to change marital status for both 2018 and 2019 or just 2019?
