Hi everyone,

My common-law partner and I are sending an application for permanent residence (he is the sponsor). I wonder - are we supposed to send the original of the Statutory Declaration of Common-law Union, or a photocopy??
If we were sending a marriage certificate, we would send a photocopy, so I am assuming that we should submit a photocopy of the declaration.. I'm not sure, though, because the Document Checklist doesn't say anything about it.

Does anyone have any experience with this?

The senior members may know better, but I believe spousal applications do not require the stat. declaration of common-law union.

My fiance and I applied for PR back in December. We applied as common law and didn't submit a Stat. Declaration and we just received sponsorship approval this past week.

From what I remember in my research is you only need to include the declaration if you are sponsoring another family member other than your common law partner, and that common law partner is a co-signer on the application.

Since you can't co-sign on your partner's application, you should be good.

Hi

Though not required, if you already have it and wish to send it as additional proof, send the original. A copy of a stat dec is not a stat dec, just as a copy of a passport is not a passport.
