Hi there,

My husband is working in Canada on ICT Work Permit and I am holding Visitor Visa(we have come last month). We have created the profile in Express Entry but our points are 430 only currently. We'll be able to claim 50 points under CEC in Feb 2021. My husband's project might get over in Jan and his company might send us back. We are contemplating the options to secure ourselves and extend our stay. One option we are thinking of is for me to get Study Permit and then him to get Open Work Permit based on that. Is it possible to get the ICT converted to Open Work Permit? Can anyone let us know about the options that we might use?

You wouldn't be "converting" the ICT to an open work permit. Instead, your husband would be applying for a separate spousal open work permit based on your study permit application.

To answer your question, this is feasible. Although as always, approval is never guaranteed.

You will taken to make sure that your planned studies in Canada make sense in light of your previous education and work experience.

Note that your husband will not be able to cliam the 50 points if his project is over in January and his company wants to sent him back home. To claim the 50 points, needs to be actively working with the company (after the one year) and they need to provide him with a letter stating that they are guaranteeing he will have a position with them for at least one year after he becomes a PR.
 
Thanks Scylla. Is it possible to hold two permits at a time? Or once he gets open work permit his ICT would need to be cancelled immediately?
