Me again! Ha, thanks again ahead of time.

My husband has not yet filed taxes yet for the 2012 year-this being said we are unable to get an original "Option C printout and Recent Notice of Assessment" sent to us.

We wanted to send our application out tomorrow being that my FBI clearance report expires March 21, 2013 (3 month period until they receive it). What makes the situation even more complicated is that he was living in the States 2010 and 2011 and did not files taxes for Canada at this time... Can we just write an explanation why we don't have the Option C for 2012 and is this a legitimate reason? The most recent one we could get would be 2009? Should we send in our application without the option C and just state it's being sent later?

You can, but you risk it either being sent back, or being delayed. It's totally up to you though.

Hey Maau0601

That's exactly what we did. We were living in the UK and it would have taken around 3 weeks for the Option C to be sent to my Canada address and for my mom to then forward it on to me. So we sent the application with a letter stating that we had requested the Option C but it had not yet arrived and that we would forward it on as soon as it did. We had no problems :)

If the 2009 one is the most recent one, then that is fine, as CIC will be able to see that he has been living out of Canada since then
 
If you decide to go without Option C for 2012, I would include a whole lot of evidence about what you have earned last year (copies of several pay stubs, including one from late in the year showing "earnings to date"), as well as tax transcripts from the US for the years he was there. Include a note that 2012 Option C from Canada isn't available yet. Although there is no minimum, they want to see proof that you have earnings that prove you can support yourself and your spouse.
 
I included an Option C from 2011, a copy of my T-4 for 2012 and a written letter from my former employer how much I made in the last 12 month period ending March 20/13 Even though I quit beginning of Feb.

Haven't filled out taxes yet for 2012....

If you have a legit reason for not filing taxes just do a note explaining same and submit it with application. My husband did the same and was approved as sponsor after one month of submitting application so no problem as long as you have a good reason. If you're out of the country, that's more than a good enough reason!

I only included Option C for 2011 and no other proof of income for 2012 except for my current employment certificate. Got my SA 25 days after submitting my full application :)
