First post so first of all I would like to say what a great forum it is. I have searched a fair bit but can't see exactly why I need to know so hoping for some help.

Basically I came to Canada on an Indra company transfer end of March this year. I had been with my Cabadian citizen partner a good while and got engaged `Sep 2015 so my work were good enough to find me a position here which I took. We were married in July and we applied for spousal Per about 2 months ago choosing inland for the OWP availability.

So I have a work permit which is closed and expires end March 2017. Stupidly I did not apply for OWP along with PR.

Should I have any issues applying for OWP due to me already having a closed one?

What in gods name do I select when it asks what I'm applying for it's so confusing. I'm a UK citizen if that helps

Thanks in advance

Doug

Also when it asks about intended name if employer etc. What do I put?

I'm hoping for an OWP so I can change employers if necessary so do I just leave it blank or would I put in my existing employer (listed on my current closed permit)¥¥confused

1. You really should have considered the Outland application. Being from the UK, your PR would likely have been approved within 6-8 months, based on what those in the UK Outland thread are reporting.

2. You can send the OWP now. Make sure you include a note indicating that you've already submitted an Inland application and (most importantly) that you still have legal status in Canada.

The form that you need to fill is IMM5710. Select `new work permit' (or similar) and `employer unknown'. The total fee is $255 ($155 for the OWP + $100 for the Permit Holder Fee).

Ponga thank you so much. I considered heavily the Outland but to be truithful I am not happy with my current employer and would like the option to move.

So I needn't mention my current work permit or employer?

You'll probably need to show that you have a valid [closed] work permit, but there's no need to show your current employer for your new OWP.

The OWP that's available to an Inland applicant, is somewhat special, in that it is an automatic approval based solely on a [complete and error free] Inland spousal sponsorship application that has been received by CIC, as long as the applicant still has legal status in Canada on the day that they are received by CIC. Even though you did not include it with the Inland application, you will be under Implied Status as soon as CIC receives the OWP.
