Ok so hubby is currently on vistors visa until Sept 1 2010. When we applied for it we showed we were married and stated we were working on PR app (not submitted just working on). So now I have said for his reason for extension....... I currently have a Perm Resident application in process and would like to stay with my wife while it is being processed. Is this ok or should I change my wording? Also we asked for 6 months....is it too risky to ask for 1 year?TIA :)

Hi,

Question, are you applying for PR Inland (meaning applying within Canada) or Outland (meaning applying from your hubby's country)?

If Inland, then you can extend his visa with an open work permit which has a longer validity than a visitor's visa. This way, you don't have to keep renewing his visa while he's with you in Canada. You must apply for this work permit with your Inland application 30 days before you husband's visitors visa expires. You won't get any reply with regards to the work permit until after about 6 months. But nothing to worry about, as long as your husband applied for an open work permit with your Inland Application, he will have "Implied Status". That means he can stay in Canada until a decision is made on his application for a work permit.

If you're applying for an Outland Sponsorship, since I don't have any experience with visa renewals, I won't be of much help with this topic. Hopefully other members can share their thoughts.

I have applied for outland and on my 2nd 1 Year Visitor Record..

I had a 6 month Implied status in 2009..May 2009 I extended my stay and asked for 2 years..I said I was applying for PR Inland and I was given 1 year from Aug 2009..Shortly after I found out I could apply outland, we had just got married so we were not ready to apply..For various reasons we did not submit my PR application until May 27 2010..so I re-extended my stay..I asked for 1 year stating that I have applied for PR..I included a photocopy of my receipt for my PR fees (We paid 1 month in advance for my PR just to send the receipt although we didnt submit the application at that time).

Is your Husband from a Visa Exempt country?? If he is already in Canada CPC- V usually issues another Visa...
 
My husband is from the USA. Is my reason good enough do you think? Should I ask for 1 year?
 
Ahhh...yes ask for 1 year...I cant see why CPC-V wouldnt give him a year...and if they think its too long then they will issue it for a shorter period of time..better to ask for too long a time period than too short! Saves re-extending in 6 months time if his pr application takes longer than expected! And that is not uncommon! Just make sure you supply proof of:

- Marriage - marriage Certificate

- Funds - My Husband wrote a letter stating he will support me and we gave the a photocopy of 6 recent payslips, a letter of employment and a copy of his most recent tax assessment...this seems to be good enough proof..

- Photocopy of proof for PR...if your mailing it soon then I would recommend paying fees now if you can..Takes 6 weeks for CIC to process them so it should also help your sponsorship application get processed faster (29 days for us)

- Proof of Your Husbands current Visitors Record..and photocopy of his passport..

We sent our marriage certificate the first time so we need to resend? The first time I was working and sent the letter in,now I am on EI. So we live off of that and my husband has a Inheritance he gets in monthly payments. Already paid the fees but I guess I can include the receipt a second time. Just not sure what we should include for the funds part...
 
I'm interested in this topic as well. We are hoping to get our PR app submitted within the next week or so (outland, applicant is from US). The plan was for him to move in with me later this year (possibly November) after we have the PR app in. We're married and I can show proof of being able to support him financially.

Anyone had experience entering Canada as a temporary visitor while the PR app was in process and being honest about this with the border guard?
 
There are a few people on here that have had their spouse visit during the PR process..as long as your Husband can prove he will leave again you should be ok..he needs to show he has ties in the USA..for example proof of his place of work in the USA..Proof of owning his own home or renting..if he is flying in then proof or a return ticket..he wont be allowed to come permanently not until he has PR..best way to get around that if you want him to live with you is for him to come in for a Visit before you mail PR then just not go home as he would have implied status for 6 months..then can extend his status..
 
Yep, be prepared with as much proof as you can. Also he should be able to show proof of health insurance to cover his visit.

Yeah I haven't been able to figure this out. There was another post that said that if we crossed the boarder together, and I spoke for him as the sponsor, he could get a TRV longer then 6 months. Just looking if anyone has ever done that. I have a friend who went through the PR app process several years ago and claims to have done it to get her husband in Canada (even brought a truck full of their stuff at the same time)... only they abandoned their app while it was still in progress because she had him charged with assault, deported, and divorced.
 
Kess: Unfortunately when a PR application is submitted and your spouse is outside of Canada the door of opportunity usually closes regarding your spouse coming to live in Canada on a Visitors record/Visitors Visa or implied status...


Yes sorry I forgot Health insurance..I didnt submit that as I showed proof of being on my Husbands medical at his work
