I am a Canadian Citizen living in Toronto. My husband has OWP, he lives in Calgary. We applied under Spousal - in land and mailed out application to Mississauga center on October 15'2015. It was received by Mahmood on October 16'2015. I called on feb 15'2016 to follow up (honestly, I called 3 times) and call center agents couldn't locate our file. I even filled out webform to inquire about our file. Apparently they have 90 days to reply. We attached his original criminal record documents.I am afraid that they have lost our file and original documents. :( His work permit is expiring in 6 months. I am soo worried that we are running out time and he would have to apply for criminal record check in India and that might take some months. I am so confused and worried.

Please help.

If you have your receipt number from payment you can try to use that with ECAS, try with both you and your husband's info.

Not sure where your file is at. But I must advise you to start living together with your husband. If you remain living in different places you are subject to a refusal of your inland app without a chance to appeal. One of the conditions of inland application is that the sponsor and applicant continue to live together throughout the entire process.
 
Your inland app will most likely be refused because you aren't living together. I suggest you withdraw your inland app and submit outland.
 
How can I submit outland when we are living in Canada?? We both are living apart coz of our work.

You're allowed to apply as outland while living in Canada.

There is no requirement to be outside of Canada to apply outland.

Given that one of the basic requirements of inland is that you are cohabiting in Canada, you will most likely be refused, regardless of why you are living apart.
 
I checked in the guidline on inland and outland.
For Inland it says
spouse living with you IN CANADA.

OUTLAND
it clearly says -
family member living OUTSIDE OF CANADA.

???
 
The inland section also says this:
The family class is aimed at faster processing of spouse or common‑law partner applications from applicants outside Canada.

Processing times for spouses or common‑law partners in Canada are generally longer.

The person being sponsored can apply to a visa office outside Canada to take advantage of the family class processing standard. Processing times for applications processed in Canada are posted online.

So CIC clearly sayd that you can apply outland for faster processing.
