Hi Future Canadians :D

Is it possible that somone may fulfill the required 4 years but we still have to wait an extra year to fulfill the tax requirements !!

This is our facts below :

-We landed in Canada at August/2015 and Came back .

-We are Moving Permanently at January 2018

-My Wife stayed in canada 1 Month (2015)

4 Months (2016)

2 Months (2017)

= 7 Months Total

-During the first three years after landing we did not file any income tax as we did note settle in Canada.

- after we will finally move to Canada at January/2018 , Theoratically my wife could apply to citizenship after 3years+5 Months = June/2021

BUT

-She would only filed income tax for 3 years so far ! that is (2018,2019,2020) so does this mean she would have to wait an extra year in order to file the next tax report at April/2022!!! and then apply for citizenship ?

Thanks for your Help

The current rule for citizenship is:

" You must have been physically present in Canada as a permanent resident for at least 1,460 days during the six years immediately before the date of your application. You must also be physically present for at least 183 days during each of four calendar years that are fully or partially within the six years immediately before the date of application. "

She needs 4 years being present at least 183 days, so 2017 won't count. She will meet the 4 years in January 2022.

You don't actually need to wait to file the tax. For every tax year there is a box to indicate you were not required to file that year.

Thanks for your reply , but according to what you are saying the 7 months she collected during the period before we moved to canada permanantly will not count ?

- If she applies a month later ( July/2021) wouldnt this mean we could apply as by that time we would satisfied the 1460 days rule and in the same time lived 6 months/year in the past 4 years !

thanks

When its time to apply, just check the current requirements at that time, and follow that.
Too early at the moment.
