Hi everybody,

I need your help and advise. I married 4 years ago, and I sponsored my wife but her son (11 years old) from previous relatisonship wasn't able to accompannied my wife to Canada because his dad didn't sign the papers (although he was included in the documents and had medical, etc.). Now I'm able to fill again the papers and sponsor him since the lawyer in Dominican Republic have an afiddavit the father never show up to her office. My doubt is how I should fill the forms. Is this an extension from my wife's file? do I have to fill again those forms as I filled the first time? how I should proceed? Anyone has had the same situation? Any advise will be appreciate. Thanks.

1. It is your wife that sponsors him, as he is her son. She files a fresh sponsorship and application. new medical will be required.
2. She will still have to prove custody and the ability to remove the child from DR.

Now that your wife is PR, she is the one who will have to do the sponsorship. You can be her co-sponsor but not the main sponsor.

Finnally we can get the signed affidavit from the biological father of my step-son, and now knowing my wife is the one who will have fill the sponsorship application, my worries are:

1. As the sponsorship agreement for my wife (Signed by me as sponsor), is close to the end (January 20th, 2014). It's neccesary to wait until that day to porceed? My wife and I have now two new children and my wife is in home all time (No job for her), so she as sponsor don't make any money and only my salary will count and we still are under the sponsor agreement.

2. If I'm shy to reach LICO (now we are 5 in my family). It's probably the request will be denied? The family will be separated? Is there any humanitarian reasons?

Again, thanks in advance and any advice will be appreciated. We are a couple trying to reunite my wife son's and his new brothers and fighting with all this process.

Since the 2 new kids are canadians born in Canada, they should not be part of the income level requirement. Beside I thought son/daughters are not part of the income requirement. Not sure why you are concerned with that since your step son is your PR's biological son.

Your wife will be the sponsor, she do not need to prove income. But she and you if you are a co-sponsor need to prove that you pay taxes. The same that you sent for the application of your wife. Don`t worry, they can refuse only if biological father have a custody and say no. He must sigh a declaration.- declaration is for my region, for your probably you know .

1. No, you don't have to wait until that sponsorship agreement ends. It's fine that yours is the only income.

2. LICO doesn't apply when sponsoring a dependent child, so don't worry about that. You and your wife just need to show that you can support your family without social assistance.

In situations where the LICO applies, Canadian citizenship doesn't make a difference. Example: a Canadian couple sponsoring the wife's parents must meet the LICO for 4 people. If the couple had 2 Canadian kids, they would need to meet the LICO for 6 people.

Now I have more clarity about this process. I was worried thinking my income is not enough and the application could be denied. I'll finish filling all forms and let you know if I have nother doubt/concerns. Thanks again for your advises, your help means a lot for me.

I send my application but it was returned because my wife (the sponsorship) didn't include an original "Option C Printout" from Canada Revenue. We sent a copy of my (husband/co-signer) last Tax Return since I'm the only one working and the only home income. My wife must be in home taking care of our other two kids borned here in Canada. I'm wondering if this is going to be an issue due to her line 150 is null (not income) or if this is only a request to confirm we are filling our taxes. Could you please advise me? Thanks in advance for your help.

You will have to resubmit it with original Option C prints or NOAs.

As said previously, it doesn't matter that she has no income.

The Option C is a required document; you didn't include it or an explanation as to why it wasn't there, so the app was returned incomplete. I believe the Option C is how CIC determines whether a person has received social assistance in the previous year.

Also to verify official income as well for LICO qualifications.
