Non accompanying parent declaration form my ex refuses to sign

I would like to sponsor my daughter in Africa who is aged 16 years to canada but her father is refusing to sign the declaration form of a non accompanying parent and give me the consent letter,basically he doesnt want her to migrate life is hard back home and the child wants to come and go to school in canada.now the question is how do i sponsor her and bring her without the declaration form signed and the consent letter from her father since he is being difficult.

You need to get sole custody of your daughter through the court system of your home country.

Okay thank you for your help..once i get it do i have to submit the copy to immigration.and that would mean i dont need the fathers consent right
