I have a few questions regarding declaring a non-accompanying common-law partner (canadian citizen) in my Express Entry PR application.
In the document checklist, I see a request for the Statutory Declaration of Common-Law Union (IMM 5409) and I would like to clarify the following:
- Is IMM 5409 mandatory in this situation, even if my partner is a Canadian citizen and non-accompanying?
- Do I have to provide completed and notarized IMM 5409 or can I provide other evidence such as joint lease, bills, bank statements instead?
Regarding Family Member Proof of Status:
- Does this requirement apply only to my partner, or does IRCC expect proof of status for my partner’s family members as well?
- If my partner is a Canadian citizen is providing their proof of status sufficient?
I am uncomfortable requesting proof of status documents from my partner’s family members, especially since they are all Canadian citizens and not related to my application. Would a Letter of Explanation be acceptable if those documents are not required?
