Hello everyone,

hope someone had the same situation as me and is familiar with it . I'm from Visa exempt country and when i entered Canada (by land) the boarder officer didn't stamp my passport. So i entered may 9,2014 - got married in july and applied inland with OWP on october 2014. ( my visitor status expired november 9,2014)

If i dont have a stamp in my passport, will the officer that process my inland application be able to see that i actually entered Canada on may 9,2014? does the boarder officers scan/register passport when you enter?

Any response highly appreciated.

Same thing happened to me, where they didn't stamp my passport when we cross the border by land. The CBSA agent told me it was to discourage people to go in and out just to restart their six months visitor status. I came across another guy on the forum though who said they got a stamp no problem, so I think it's case by case.

Anyways to answer your question, I don't think it would be in the system, because I was sent in to secondary because they accused me of overstaying. My guess is if it was on their system that I crossed the border less than six months ago, they wouldn't have sent me in to secondary. If you are worried about overstaying, try and get visitor record maybe?
 
I thought that one of the required documents for the application, was a scan (of your passport) showing the latest entry stamp into Canada.

Or have I completely lost my mind?! ;D

I'm sure that CBSA knows that you entered Canada on May 9, 2014 and that if CIC needs proof, they can simply pick up their red `Bat Phone' that's a direct line to CBSA.
 
They're not that sophisticated. My wife must surrender her I94 as a result (before it expıres) in order to generate an 'exıt record', from the US. Without it she would have difficulty when attempting to get her next I94. Granted, it's nice that your current I94 can be tied to your Nexus card.

i'm sure they want to see the stamp in passport, but if border officer didnt stamp my passport, does it make me ineligible to apply inland?

No, it doesn't make you ineligible; CBSA often doesn't stamp visa-exempt passports. CIC will be able to see your entry date in the system.

My own case a little different, also from visa exempt country, the officer only stamp in the date i entered without expiring date despite request of 90 days on my form. What I don't then understand is am I given the requested 90 days or the normal 6 months?

In what way does that discourage people from doing that? I'm confused. I have been travelling to the US to restart my visitor status since Dec 2013, but my shortest visit to the US was a 3-4 day trip and it was by plane. I have a NEXUS card, so not only do I not get a stamp, but I don't even talk to a human.

It means you have 6 months.

Ditto on that. I applied inland and had no entry stamp. It has not been a problem. I did feel more at ease though once I applied for an extension after 5 months and had the visitor visa in my hands. Just write down the date and send in your new visa application before six months. Someone else can chime in on the OWP and maintaining status under the new OWP program though.

The CBSA agent actually gave me a lecture on that, so when your 6 months is up, they expect you to actually leave and not just come back few days later (which is usually the case for land crossing). I guess it's to respect the 6 months visitor status? And if you have a reason to stay longer than 6 months they expect you to go at it the proper way, which is to apply for an extension. Really just sharing my experience here I obviously don't know much more than you guys.
 
I see. I could argue with them that I didn't just cross the border and come back to renew my visitor status though, as I actually had the primary purpose of visiting my kids in the US during those trips. I would gladly have submitted an extension, but it didn't make sense since I was going on the trips either way.
