I applied for PR under CEC in August 2014. I am married and i did not include my spouse as our marriage broke up. I filed as legally separated and attached a declaration and written explanation why I did not include my spouse in the application.

I am still stuck with this situation.:(:(:((I got my MR, RPRF and waiting for PPR. CIC again need clarification regarding my relationship. how best can I explain them with out a divorce as my spouse will not give me divorce as I did not include her in my PR application. please advice. what other documentations can I provide. I did send them the declaration and the letter. plz advice what else can I provide them.

Are either or both of you located in Canada?

IF:
- you (or your spouse) have been a legal resident of Canada for 1 year, AND
- you have been living separately for at least 1 year,

you can get a divorce in Canada. You do not need your spouse's permission to apply for a divorce.

Best advice - seek the assistance of a lawyer.
