I am a UK citizen and my wife is Canadian - we are resident in the UK and have been married 9 years. We want to discover whether we can move back to BC to be close to my mother-in-law who is now in her 80's.

1. The Sticky in this section suggests that we'll need to prove we have plans to move if accepted, but this is quite difficult to do. We both have businesses that we would bring with us and whilst we would probably sell our house here, we need a sort of 'yes in principal' answer before we take that step.

Anyone else been in this sort of situation?

2. Form IMM5406E is a puzzle. At the top of the form it says that "all dependent children aged 18 years or older must complete a copy of this form". Dependent to me presumably (as the applicant)? I have no dependent children, such that they are 21 and 25 and have jobs and lives of their own. My wife similarly has 2 children, aged 23 and 25 - in a similar situation. Do they need to complete form IMM5406E or do we just complete a form each and include them on it?

Please excuse what are probably basic questions

Should you apply for the Sponsorship route i.e. your wife sponsors you then you must obtain an upfront medical. The results of your medical are sent electronically by whomever performs it and once you actually apply through the sponsorship route your medical results are matched up with your application. The current waiting period for UK citizens is 14 months but I got through in just over 5 months. If everything goes well i.e. no hiccups and CIC don't ask you for any furtehr information you'll receive as passport request, which involves sending a photocopy of your British passport to an office (usually London for UK applicants). Once you receive your Confirmation of Permanent Residence through the post (I received mine within 10 days) you have up until one year from the date of your medical to 'land' in Canada. If you wait until after that period you will need to start the whole application process again. However, you may 'land' and come back to the UK to tody up your affairs, you will not need to land again when you return to Canada.

2. They are not dependent children, so they do not have to fill out their own forms. You simply include them on the Additional Family Information form.

I am in the similar position as my wife is residing with me here in the UAE and we have to provide proof for us going back. What would be the proof or we just have to write a letter of intent to explain our plans?

It is very important that you put as much thought and effort as you can into proving you are moving back to Canada. Cic looks at this very closely. Anyone who makes such a big decision as moving to another country does so after a lot of research and thought. You need to show that process to cic. Job, housing, social prospects. Even discussions with friends and families. Do not take this lightly.

They are not dependent children, so do not fill out this form. Only the applicant fills out the form. The sponsor does not; the form says the spouse should fill out the form to, but this does not apply to people being sponsored. The form is used for other classes of immigration as well, where both partners are immigrating.
The applicant fills out the form, and includes the sponsor as the spouse; you should list your parents and children as well - this is not because they are immigrating; CIC just wants this information; and all siblings.
