Not sure how this is related to the election. Either winner would have had to take action and likely very similar action. Non-partisan bureaucrats make up the majority of IRCC.

80 Paragraphs 101(1)‍(b.‍1) and (b.‍2) and subsection 101(1.‍1) of the Immigration and Refugee Protection Act


  • (a) do not apply to a claim for refugee protection made before the day on which a Bill entitled An Act respecting certain measures relating to the security of the border between Canada and the United States and respecting other related security measures is introduced in the 1st session of the 45th Parliament; and
  • (b) apply to a claim for refugee protection made during the period beginning on the day on which that Bill is introduced and ending on the day before the day on which it receives royal assent.

I would still expect that some action will be taken to address the backlog of cases. The volume of cases in the backlog is not manageable given current processing methods. The focus on minimizing the number of new cases is more urgent so it makes sense to focus on this first.

Not necessarily. The majority of Canada and conservatives in Canada are more centrist. PP was not calling for a ban on asylum seekers. If anything some of the statements from PP were more moderate than Carney. If anything government lawyers likely had the most input on what changes could be proposed anticipating legal challenges

To be fair this plan likely was started under Marc Miller who suggested around last November to expect an announcement regarding asylum but sadly December came and went with no announcement. Then proroguing happened so there was no opportunity for changes and the election. These things don’t happen quickly. Unfortunate that it wasn’t in place last fall.

I dont think so. I believe proposed changes were similar to the plan of the previous government which is to fast track refusal at eligibility stage. That is where authority of IRCC lies. Once claim is referred to IRB, it will be entitled to due process.

Not suggesting current applicants would not get due process. Identifying targeted groups for faster processing would be an option. Processing groups of applicants quickly because most don’t have grounds for asylum would be a good option.
 
My case was filed after a year and 2 months in canada when something happened back home. I have been referred to IRB since august 2024. Will this new proposal affects me
 
I don’t think this proposal should be passed. Anything can happen anytime. Situation can change anytime . For someone declared wanted in home country more than a year living in canada , where does that person stands.
 
And why did the Government implement these changes ?

Outright abuse / manipulation of the system

No one ever mentions anything about that .
Either people giving advice or those commenting

It can be plain as day , and people nonchalantly claim asylum , abuse the system , then complain
Highly doubt those are the reasons for govt to propose these changes. The real reason is probably to impress Trump administration and try to negotiate a better deal to save our economy.

If the govt was really concerned and wanted to clean the house, they will process the 280k pending asylum claims first by pausing any new claims and allocating proper resources.

The integrity of the immigration system has been compromised for a long long time but the govt analysts and policy makers are least concerned until it becomes priority for law makers. For starters, the majority of current asylum claims are from a country which is generally stable and is not at war.

Imo, these "proposed" changes will remain "proposed" until next election.
