Hi All,

We immigrated to Canada late last year. We imported car, got a lease, etc. My children are gong to school in Canada but i continued my consulting business in New York for another two years under a contract. I visit my family in Canada every month for few days. Knowing about 730 days RO, could there be any problems at the border early for any reason. Border agent ask me when would i move to Canada but on explanation from me, they are o.k with it. But i am just wondering if there is any chance of me getting stuck at border before i hit two years of absence. Please comment. Thanks.

What do you mean by being 'stuck at the border' - refusal of entry as a PR?

If CBSA agents can confirm you are a PR either by you presenting a valid PR Card/ landing docs or their database checks then you will be admitted. If you attain (or can) 730 days of physical presence in Canada in the 5 years dated from PR acquisition late last year you meet the Residence Obligation and will be ok when interacting with CBSA/CIC e.g. PR Card renewal. If you don't meet the RO then you risk being reported. As a recent PR you have some time to get the 730 days.

Remember there is a customs function at the border too so you may get held up while these are carried out.

Keep a solid record of your travels...you need to declare all dates when renewing your PR Card. Are you filing Canadian taxes? What other proof do you have of your days in Canada?

Thanks Msafiri,

I meant to say refusal of entry as a PR. You are right and "or can" is what i wanted to confirm. Yes, i filed Canadian Tax Returns. I have travel record which is the only proof of my stay in Canada.

Regards.
