Hello everyone,

I just came across this info on CIC website regarding the implied status:
http://www.cic.gc.ca/english/resources/tools/temp/visa/validity/implied.asp

- If the extension is approved, the date of issue shown on the document represents the date a decision was made. Observations in the remarks box of the document indicate that the applicant maintained their status, as per subsection R183(6).
- If the extension is refused, the applicant is considered in status until the day the decision is made on their application.
- If the extension is rejected (incomplete), the applicant is considered in status until the temporary resident document expires.

So it means people submitting BOWP without AOR to buy some time will not benefit at all ???

So if I understand correctly, this means that there will be no implied status for those that are submitting their BOWP applications without AOR?

What exactly is complete? CIC did not say it very straightly regarding missing ITA/AOR.

So here are the stuff quoted from CIC

Extensions
If the extension is approved, the date of issue shown on the document represents the date a decision was made. Observations in the remarks box of the document indicate that the applicant maintained their status, as per subsection R183(6).
If the extension is refused, the applicant is considered in status until the day the decision is made on their application.
If the extension is rejected (incomplete), the applicant is considered in status until the temporary resident document expires.

Note: If your application is rejected as “incomplete”, it is considered to have never been submitted and therefore you would not benefit from ‘implied status’. If you reapply after your current status has expired, you will need to apply for restoration of status. See the section Restoration of Status.

The Case Processing Centre will review your application to determine if it is complete. If your application is not signed, if all mandatory sections are not completed, or if the required fee is missing, your application will be returned to you and you will have to re-apply.

End of quote.

It didn't really say missing EE ITA/AOR is counted as incomplete. Anyone can state a clear answer?

Don't be scared. This is not some "new updates". CIC's explanation of Implied Status has always been like this, at least since the last time I read it (2 months ago)

Your application won't bee deemed as incomplete as long as all application forms are completed and signed, and all documents on the checklist attached (proof of payment, copy of passport etc. EE AOR is not on the list though).

Before last year probably there was no mention of incomplete applications.

So, applicants will send extension of WP application to buy time without supporting documents. By law, CIC had to give those candidates implied status.
Since backlogs in PNP, more and more applicants were running out of time and to buy time and stay in Canada applicants will send WP extension paper application which takes 90 days to process, So once refused they get more 90 days to restore status so then they will restore status as Student, Visitor or WP (LMIA or PNP)

So this was happening before and after flood of applications they decided to change it.

I have already applied for BOWP and my work permit expires. Shall I resign now or I can keep working? I actually have AOR from OINP at the time when I sent my application.

lol, it has always been that way, there is nothing new.

Incomplete means if you missed anything from the checklist that making the officer unable to reach a decision for your application.

Don't be alarmed, as long as you submitted a complete application in time, you are in the implied status.

Actually, AOR is on the list now, so w/o AOR the application "might be" rejected as incomplete.

We will actually know when someone actually tries to apply without AOR...

AOR has always been on the list since the beginning but the incomplete application and rejection results were just out this year.
