Notice – Changes to strengthen employer accountability under the International Mobility Program
February 9, 2015 —

Employer compliance system and fee

Starting February 21, 2015, employers hiring foreign nationals who are exempt from the Labour Market Impact Assessment (LMIA) process will be required to submit information about their business or organization, the Offer of Employment form, and pay a fee to Citizenship and Immigration Canada.

As of that date, a foreign national who is exempt from the LMIA process will not be able to get an employer-specific work permit if their employer has not submitted the required information and paid the fee before the work permit application is submitted.

The employer compliance fee has been set at $230 and must be paid online. The fees collected will offset the cost of introducing robust employer compliance activities featuring inspections of thousands of employers.

When an inspection finds that an employer is non-compliant, the employer could face an administrative monetary penalty, a ban from hiring foreign workers and, in serious cases, a criminal investigation and prosecution. The adoption of this system will mean that all employers, whether they are hiring LMIA-exempt foreign nationals or temporary foreign workers through the LMIA process that has determined that there are no Canadians available for the job, will face the same level of scrutiny in their hiring and treatment of foreign workers.

The employer compliance fee does not apply to employers hiring foreign nationals who have open work permits. Open work permits allow the holder to work for any Canadian employer.

New fee for open work permit applicants

A fee of $100 will be collected, also starting February 21, 2015, from open work permit applicants. This fee will be paid at the same time as the work permit processing fee and can be paid online. The fees collected will offset the cost of new initiatives to improve data collection on the role of open work permit holders in the Canadian labour market, as well as increased promotional activities to encourage open work permit holders to apply for permanent residence.

International Mobility Program streams that feature open work permits rather than employer-specific work permits include the working holiday portion of International Experience Canada, the Post-Graduation Work Permit Program, spouses/common-law partners of highly-skilled foreign workers and international students, and certain foreign nationals who are already in Canada waiting for the finalization of their applications for permanent residence.

I don't believe it will help. For open work permit holders, it just means an extra fee to pay. For others, such as NAFTA, employers will have to fill in a form and pay a fee. This will discourage some of them from offering jobs, but those jobs will not become LMIA-approved, because employers still don't have to prove there are no Canadians who want the jobs.

I think they are trying to find out what kind of jobs people with employer-specific work permits are taking, whether they are being paid fairly by Canadian standards (that is, is the employer hiring foreigners because they're cheaper?), and perhaps, ultimately, if the jobs are desirable and fairly paid, how to prevent employers from hiring foreigners to do them.

The idea that the money from open work permit holders will be used to encourage them to apply for pr is ludicrous. We're already here, banging on the door to get in, and even those with the highest scores in education, languages, and Canadian experience have lower scores than those with LMIAs.

If they are going to make LMIA an "absolute" requirement, as of 21-Feb-2015, it will "seriously" become "difficult" for majority of people in the EE pool who have 300-500 points, myself included, to get to Canada or get a job in Canada.

I wonder how Canadian employers are responding to this. Their response is a puzzle.

For International Students, there will be another $100 charge, when applying for PGWP (Post-Grad Work Permit).

"A fee of $100 will be collected, also starting February 21, 2015, from open work permit applicants."

"International Mobility Program streams that feature open work permits rather than employer-specific work permits include the working holiday portion of International Experience Canada, the Post-Graduation Work Permit Program, spouses/common-law partners of highly-skilled foreign workers and international students, and certain foreign nationals who are already in Canada waiting for the finalization of their applications for permanent residence."

No, it doesn't say that. They are talking about employers who hire foreigners for LMIA-exempt jobs.

That's a bad news...Now it would not be easy to find job on PGWP coz the new change would require the employers to apply for LMIA for the foreign workers before hiring. But as we all know that none of the companies want to do the LMIA coz of penalities imposed if the employer is non-compliant...

Now the future students who were planning to come to Canada for studies should consider applying to other countries coz now there is no sense in paying thousands of dollars fees when Canadian goverment doesn't value you. Canadian government makes huge profits by inviting international students and this inturn boosts their economy, but what are we getting in return?...stupid rules and regulations which don't even make sense...

No the employer does not need to apply for LMIA for PGWP holders. PGWP is an open work permit and people can work for any employer as long as it is valid.

The only thing it says about PGWP holders is you have to pay extra $100 when extending your Work permit.

Pgwp is one time permit how we can extent that??
If you get an ITA before your PGWP expires, you can apply for bridging open work permit. If not and you are still in EE pool, you have to leave Canada unfortunately :(. One way to extend your stay here is to go back to school and get study permit
