Hi everyone,

This is my first time to write a post in a forum.. I've been reading a lot of the discussions here and so I decided to seek for opinions from you guys. So here's my story...

I am currently in the US, I got here just last Dec 2010. I went here as an H4, unfortunately, I turned 21, it means I am no longer eligible to be a dependent of my parents (they have H1b visas). Before I turned 21, I applied for a tourist visa, which luckily got approved. I looked for some jobs and I applied for an H3 visa.. It got very complicated and had some issues regarding the agency that I used to get the job and their really selfish procedures (they asked me to pay a LOT of money). I decided to cancel the application. With that being said, I am now officially out of status. I really don't want to live like this but my parents doesn't want me to go home since I am from a 3rd world country, they think I will not have any future there.

I want to apply for a PR in Canada for a chance of a better life, am I eligible to apply? I have a Bachelor's degree and I do have atleast 1yr experience.. I would also like to know what will be the process if I can apply..

I would appreciate your opinions regarding my situatuion.

Yes you can apply for Canada PR...as far as you were legally accepted into the U.S. for at least 1yr.
But you need to have a clean police recored and health bills in addition during the process...

Please other expert lets help this memeber...any suggestions?

Without knowing what skill level and occupation your 1 year of experience is in, it is difficult to know if you are eligible for FSW without having a job offer. Have you done the self evaluation to see how many points you could get? You must have 67 minimum as well as the IELTS English exam. Go to the CIC website and look at the various ways to immigrate and see what works for you.

TOEFL isn't accepted. You need IELTS.

You can't apply right now through the Federal Skilled Worker program without a job offer in Canada.

I GOT 71 AND NOW ALREADY GRANTED VISA IN LESS THAN 6 MONTHS....(ITS A BLESSING I GOT IT IN LESS THAN 6 MONTHS)

I see, with my experience.. I think I would not qualify that much without a job offer.. I just had atleast 1 yr..
 
What is your occupation and NOC code? That is critical if you are to apply under FSW. If your NOC is included in the demand occupations when they open the 2013 applications you will have to have one full year of employment in that NOC in the past 10 years. If your NOC is in skill level O,A or B, then you will require a job offer. If your occupation is in Skill level C or D, then you MAY qualify for a Provincial programme, so check out all the Provinces and see which occupations they need. You may be able to apply for PNP and PR within 6 to 9 months of working in that job.

I will research about the NOC code.. But my first job is in the IT field and the second is administrative.. I will also check out the Provincial programme. Thank you so much!
