I just want to inquire what are the requirements if you want to adopt your nephew/niece to Canada? What Categories the CIC is looking at in these type of application.

Both Parents are still alive but not together and the kid is leaving with mom.

It's only possible if they are orphans and both parents are deceased. Otherwise not possible.
