could some one name a good and respectful lawyer for the sponsorship issue other than David Cohen (lawyer of the forum) because I contacted him before but he was unable to help .

please i am in a bad situation and i am unable to sponsor my son i need someone to name a good lawyer immediatly
 
If you say that Mr. Cohen can't help you...maybe your situation can't be resolved.


How old is your son? If he is NOT under age 19, you cannot sponsor him (as of the new rule of 1 August, 2014)

he is 7 years old and i have the legal sole custody the problem is i am unable to get the consent of his non accompanying father

You should be seeking legal assistance in your home country (rather than in Canada). You need to work with a lawyer located in your home country to help secure consent from the non-accompanying father.

I don't see how a Canadian lawyer can help you.

how a lawyer can secure an consent from his father if he refused to give the consent just to humiliate me. I am seeking a legal advice from canada because i have several official records of beating me while we were married.
 
I think this comes under custodial case, rather than sponsorship. So, like scylla said, it makes sense to fight for custody of the kid in the country that the kid is in. Once you win custody, or make some reasonable arrangement with the father, you can apply for sponsorship the normal way. Canadian lawyer cannot help you win custody of your kid in a foreign country I think. Aside from this, I'm sorry for what happened with you. Good luck!

I have the sole legal custody. my problem is the inability of getting the consent from his father. and i would like to ask if cic can process my file under H&C due to his bad history with me and his som
 
Sorry to hear of your situation. The issue is that CIC is very very sensitive to potential child abduction cases. If there is any such potential for getting blamed in helping with a child abduction, they want to avoid at all costs. That is why they are so big on consent. So even though you have sole legal custody, CIC is still cautious. Good luck with your case. Unfortunately I don't have any useful advice to offer.
 
Sorry, my bad. I missed the part with legal sole custody. Hmmm, I would have thought having legal custody would be enough to sponsor a child by yourself without consent from other parent. But, I have no info on this. Hope someone on the forum helps you out. I think even with sole custody, there are things like visitation rights and other legal details that could get impacted here. That is why it is good to also have a local lawyer involved make sure.

all the right he has is to see his son and he has never asked to see him either in friendly way or through court order.he is not interested to see his son at all
 
So he does have legal visitation rights? If he does, then the issue could be that if you take him to Canada, he cannot freely see his son since he would need a visa to come to Canada. While he may not care now, he could raise the issue in the future and argue that his rights are violated. These are the types of issues CIC is worried about.

as i said he did not use this right since our separation in 2009 because he doesn't care he just want to humiliate me. I have police records that he assaulted me and i have court order that shows i got the divorce because i was beaten and assaulted by him. what should I do?
