Dear Senior folks,

I need your guidance to my case. My work experience is only with one employer since Aug 2017. During this 13 years, I traveled to onsite multiple times on deputations and got many promotions. In 2019 my company has processed my ICT closed work permit for NOC 0213 and I moved to Canada in Apr 2019 from USA for same employer but its Canadian entity. In my EE profile, I entered the details separate entries based on designations and location. Below is the snapshot:

DATES

OCCUPATION / ACTIVITY

COUNTRY

NAME OF EMPLOYER

APR-2016 to APR-2019TECHNICAL ARCHITECTUSAXYZ INC0213

AUG-2008 to NOV-2009ANALYST PROGRAMMERINDIAXYZ PVT LIMITED2174
AUG-2007 to AUG-2008GRADUATE ENGINEER TRAINEEINDIAXYZ PVT LIMITED2174

I got invitation under CEC. My CRS points is still above cutoff if they consider only with my CEC work experience and atleast 1 year of Foreign exp.
I have few queries on which I would need advice/ clarification:
1. My company is large organization, and does not provide reference letter with job duties. They only provide one employment verification letter that will contain Emp name, initial DOJ when I joined them in India, current designation title, current salary. The company name mentioned is XYZ CANADA INC. There will be no mentioning of any other company foreign subsidiaries. I can get a reference letter from my current manager that I can upload it with company's standard letter plus canada deputation letter in my canadian exp. For other rows, I am planing to upload same company's standard letter along with random paystubs, W2, form16, tas return, increment/ promotion letters, USA visa petition copies, deputation letters in the respective work period. Please advise if this sufficient and attaching same company's standard letter in all rows is acceptable along with LOE.

2. To claim Foreign exp. points, Do I have to get exp. letter from previous Mgrs & notarized as it is difficult to convince Mgrs whom you left? Or I can do self affidavit mentioning job duties and notarize it. In my US L1b visa application processed by my employer, they provided duties matching 70% to 2174 lead statement on which I worked in first and second US deputations. Do you think VO will be consider the fact that I moved from US entity to Canadian entity of same employer on ICT work permit which requires one to have atleast 1 yr of exp in similar capacity in last 3 yrs within same company's foreign entity.

3. In my USA work exp just before coming to canada, I relocated to different city within USA for 5 months, but role and responsibility were not changed. This was a short term assignment and hence only I relocated without family members. I didn't mentioned this as a separate entry. I just included in my previous work city exp. Hope is the fine.

Appreciate your inputs.

1. Yes, it will work. As per IRCC the work reference letter

  • should be an official document printed on company letterhead (must include the applicant’s name, the company’s contact information [address, telephone number and email address], and the name, title and signature of the immediate supervisor or personnel officer at the company),
  • should indicate all positions held while employed at the company and must include the following details: job title, duties and responsibilities, job status (if current job), dates worked for the company, number of work hours per week and annual salary plus benefits
As long as your letter states that you have worked for the company for the entire duration, lists all your designations, job title etc. The JDs can be from your manager or any other employee familiar with your work and your additional supporting documents like your tax returns etc will provide additional proof.

2. Self affidavits are not accepted by IRCC. You can ask you company to list all your designations and the time frame in one letter. This will save you time. Though, you will have to get different letters fo different NOCs. But for all designations with the same NOC, you can use the same letter as long as it covers the entire period you worked for the company.

i.e. you can get one letter from you company that states that you worked for it from 2008 - 2014 and lists all your designations. You can supplement it with another letter from you manager or colleague with your job duties and add additional documents such as your job offer, appraisal letters, tax returns etc. In your LoE you can explain all the different places you worked for.

Alternatively, you can do the above and get separate letters for US and India.

3. You need not mention it as a separate entry. However, in your personal history you will have to list it.

Hope this helps!

@legalfalcon Thanks for the response. Is it also possible to move all foreign work history > 3 years in PH while applying eAPR. As CRS score for foreign exp maxes out at 3 yrs. Please note all this experience is with the same employer. I can mention in LOE about my all overseas deputations . This way I am thinking I have only few docs to be uploaded and hence much lesser work.
