Hi i need an advise actually my case is little bit complicated i got in canada in 2010 on student visa then i got work permit till 2015 after than i didnt get extention so i stay in canada till 2018 without any visa and got some criminal charges but at last all charges got droped but i got removed by cbsa by putting 1 year removal because i am overstaying . My brother is in canada and he is permanent residence and have is own truck repair shop .Is there any way i can get back to canada .

Extremely unlikely you will qualify for any sort of temporary residence (TRV, student visa, work permit) given your history. You could try immigrating on your own if you qualify.

Likely your only option is to qualify and apply to immigrate to Canada and become a PR througha an economic immigration stream like Express Entry or PNP. You would need to qualify based on your level of education, work experience, age, language abilities, funds to establish yourself in Canada and other factors.

Most likely any sort of temporary visa (i.e. work permit, study permit, visitor visa) would be refused due to your immigration history in Canada.

Yes i do overstay for 3 years got arrested few times but all my charges got dropped i have no criminal history and got exclusion for 1 year

And all those things make it highly unlikely you will get any sort of temporary residence.

And if cbsa paid for your flight, you’ll have to repay them before they will consider any sort of application.

In a nutshell , showing past history of non compliance with immigration laws, amongst other things
It appears you’re putting little significance on your overstay, which wasn’t days or months , but YEARS, and your removal

The other question is whether the charges against you were withdrawn or were they stayed because you were removed. Makes a big difference.

So there not gona be any issue if i appy for permanent residence visa .To be honest i got arrested few times but all charges got dropped and i do have overstay for 3 years .

As long as you declare your immigration history fully, applying for PR will not be an issue.

The challenge with applying for PR is qualifying. I would recommend you start by looking into the Express Entry program.

To be honest some are withdrawn and at last few were stayed .

You may want to consult with an immigration lawyer in that case.

Regardless, first step is to determine if you meet the requirements to immigrate. Again, start with the Express Entry program. This is a points-based program. You need around 470 points to be selected from the pool at this time. Calculate your points to see if this is a realistic option.
