I sought Asylum in United States and was denied for no reason and was kept in the detention for 1 year and 6 months in search of my traveling documents which was lost in their hand and my country of origin who knew about my predicament and danger in my home country refuse to issue my Traveling documents and i was released after 1 year and 6months in detention, now i live in United state just having a workers permit, SSN and drivers license. now I fell in love with a Canadian who we have have agreed to marry. so my question is if we get married do i qualify for Canadian Resident permit?

After you get your marriage certificate, your Canadian spouse can sponsor you to become a Canadian permanent resident. However as a failed refugee claimant for the US, your application will be scrutinized closely and quite possibly delayed. And it sounds like your passport was lost so that will cause additional issues. I think you will have a long road ahead of you I'm afraid...

Thank you for the honest answer and what if i send my passport is found and send to her? and since my asylum was denied in USA Can I apply for Asylum in Canada even though Am married to my wife? I was denied because i fought my case from detention where i could not get evident now i have more evident pls advise me

Yes - you can apply for asylum in Canada. Canada is one of the participating members of the Safe Third Country Agreement which would normally prevent you from applying for asylum in Canada. However since you have a qualifying family member in Canada - you may apply for asylum in Canada.

In your original post you stated you were not yet married. You also stated that you were trying for asylum from detention. Detention usually confers prison/jail. Why were you in Detention for 1 1/2 years in the US while trying to become a refugee?

This is likely going to have a HUGE impact on your ability for a spouse to sponsor you in Canada.

I am still unsure if a failed refugee claim in the US will give you the right for another refugee claim in Canada. I don't think it's one of those "keep trying til you find a country that will accept you" kind of thing, but I might be wrong

Either way, good luck. BTW, you'll still need your passport in order to claim refugee status at the Canada border, if you are indeed eligible to do so.

While it would be for CBSA/CIC/IRB to decide, the acronym "MoC" immediately crosses my mind.
