Need help with my wife's situation (WP/PR)

Hi everyone,

My wife and I are in a bit of a pickle. She's from Chile and I'm Canadian (Qc). We met a few years ago and she was staying in Canada through the renewal of her work permit and a working holiday visa.

We got married in march 2026 and her work permit expired in may 2026. Before her permit expired, she applied for an extension to preserve her status while we applied for PR under family sponsorship. We haven't received an AOR yet though.

Yesterday, we got news her extension request got refused, so she's currently without status and needs to stop working until we can find a way to reconcile her status within 90 days. I'm afraid our PR application may also get refused due to this.

What can we do? She's a mess right now and afraid of not having a job anymore.

Yeah we submitted it back in August.

I'm going to defer to others - I think what you may need to do is submit for either a restoration of status or TRP.

If she submitted an In Canada (SCPLC) sponsorship application, her `lack of status' should not be an issue (for the PR application) because of a Public Policy that's been in place since 2006.

If she submitted a Family Class (Outland application) that same policy would not apply.

She should research how/if `Dual Intent' may be useful in this situation, since IRCC (and CBSA) are very much aware of how this can work for people in her situation.
