Hi My wife and I applied to Canada under skilled worker class and I being the main applicant, but unfortunately we separated not legally, I just received documents to do our medical, I informed my spouse of the situation but she wants no part of it, i need some serious advice on how to proceed with this situation, I have until the end of may to submit documents. I am from Trinidad.
Ps. I used my wife family and eduction to get to the required points.
 
You have a very big problem on your hands.

If your wife refuses to do the medical - then your application will be refused unless you notify CIC that you have separated.

However if you notify CIC that you have separated, then you can no longer use your wife's family or education points towards the 67 total you need to qualify.

If you don't have the required points to qualify without your wife's family and education points - and if your wife is not willing to do the medical - then I don't see any options you have for saving your application.

So if I have the points without my wife I guess I will still have a chance. Got one question if I get through with the process but I donot plan to go to Canada say in the next ten years will my papers still be valid.
I got this great high paying job and at present I donot want to leave it, any advice will be greatly appreciated. Thanks
 
1. Yes - if you have sufficient points without your wife then you still have a chance.

2. No - your papers won't be valid. If you are approved for PR - you must land in Canada by the deadline given to activate your PR card (the deadline will be a few months long). You can return to your country immediately afterwards. However you must then live in Canada for 2 out of every 5 rolling years to maintain your PR status. If you don't plan to live in Canada for the next 10 years, then I don't see any point in proceeding with you application since you won't be able to retain your PR status.
