Need birth certificate to get daughters citizenship overseas

Hello,

I’m a Canadian citizen living in U.K. and recently had a daughter. I have applied for her U.K. passport, and started the application for her certificate of citizenship however I need a copy of my birth certificate which I don’t have. I need to replace my birth certificate but I do not have a suitable garauntor here back home in Canada. I’m feeling rather stuck. My home life over here has not been good and I’m feeling stuck because I can’t return to Canada with my daughter.

1.) does anyone know how I can get a birth certificate without garauntor and how to do so urgently?
2.) is there anyway for me to bring her back if it was an emergency, I had to leave my husband due to abuse?
3.) Would it be possible for her to fly to Canada on her U.K. passport?

many suggestions would be very helpful as I’m very stressed about all of this, she is a special needs baby on top of ball this.

How about both go to USA first and then go to a Canadian land border (by car or on foot) using her UK passport?

First, contact the consular section at the High Commission. They may be able to help. They may, for example, be willing to accept an application for (and issue) a temporary passport for the child based on your citizenship as shown by passport. (Side note that I find it frustrating that IRCC/consular sections usually ask for birth certificates and not the passports as proof of citizenship, because ... they could look it up. But yes, there are complications there).

Or, obviously better is if you have one of the other docs that they accept for proof of the type of citizenship.

2. There is a way for the consular section to issue a visa for a (presumed) Canadian citizen such as your daughter in an emergency. It's quite rare. Easier would be to fly through the USA as described in a different post.

My birth certificate was issued in Ontario so that is the jurisdiction I will need to have it replaced in.

If possible can you please explain why I would have to go through the USA for entry as opposed to just flying into Canada with her on a U.K. passport?

I’m beyond stressed due to the breakdown of my marriage, and having a child with an extremely rare genetic disorder, having to navigate how to get her back into Canada with me urgently if needed is keeping me up at night, which has also brought another matter into light. All of her specialists and therapy’s are organised in the U.K. and she needs intense therapies to aid in her development, if she were granted citizenship would she be entitled to medical treatment or doesnir not kick in until she obtains Canadian residency for 3 months? I’ve been told that as a Canadian citizen abroad for more than 6 months out of the year you lose your OHIP until you’ve returned to Canada and been settled for 90 days. Are the rules different for children?

Sorry, I'm not very familiar with the ontario requirements. Your best bet is to dig deep in your memory - after all, the list of approved individuals includes doctors, lawyers, dentists, school teachers, ministers, nurses, veterinarians.

From my experience individuals in these professions know this is a service and related to their licensing, and take it seriously - i.e. agreeing to do it, they don't see it as a burden.

Uk citizens will need an electronic travel authorization to board a plane to Canada and it will not be issued to someone who is a Canadian citizen. At a physical border, the person just shows up and says "yep, I'm a Canadian." They will not forbid entry to Canadian citizens, even if documents not all there.

Since covid, Ontario has waived the 90 day requirement, so she would simply show up and get issued one right away (with other docs of course). I presume you would too but don't know your residency history.

In addition to the other advice provided, make sure you either have a permission letter from the child's father to allow you to take her to Canada or you have been awarded sole custody of your child through the courts. You need one of these to take your daughter on a plane and leave the country.

I have reached out to the consulate regarding The birth certificate and they said it was something they can’t help with and they gave me the contact info for service Canada.

As far as trying to remember anyone who could be a garauntor, I haven’t known anyone in the U.K. for more than 2 years, nor do I know anyone in one of the required occupations. Even in Canada the only personI know in the required occupation list would have been my family doctor who has since retired. I’ve never used a lawyer and don’t have any contacts that are civil servants.

It’s very frustrating as I have a valid passport that clearly states I’m a citizen. I have emailed service Ontario, hopefully they can help with a solution.

Make sure to ask the consulate not just the narrow question of how to get a birth certificate (which yes, they cannot help with, they're not Ontario), but the question of "how can I get citizenship dosc and passport eg temporary for my Canadian child?" (Can they accept your passport as proof? I don't know).

Obvoiusly if you cannot find anyone else the process does let you apply without a guarantor, they just warn it may take longer. (Why not ask your retired family doctor?)
