Dear Experts:

Can anyone experienced please enlighten me on the issue below:

"If me and my family stays for last 2 years of our 5 year PR card, then we should apply for renewal of PR card, right?
Then will CIC provide me another 5 years period to stay as PR?
Will our last 2 years stay will be counted towards eligilbility for applying Citizenship? or the time count starts all over again? "

Please let me know. I am yet planning my permanent move. I have some responsilibilities to take care of before I can leave.

Thanks and regards.

1. Yes, they would be counted.

Please keep in mind that you must fulfill the residency requirement on the day that you apply for a new PR card, not on the day the PR card expires.

Example
- You land on May 1, 2016
- Your PR card is issued on July 1, 2016 and expires on July 1, 2021
- You are in Canada from May 1, 2016 to May 1, 2018
- You then leave Canada and don't go back for three years

If in this scenario, you applied for a new PR card on - say - June 1, 2021, you would lose your PR status. Reason: In the five years preceding the application (= June 1, 2016 to June 1, 2021), you were only in Canada for one year and eleven months. Since it is already June, your one month stay in May 2016 will NOT be counted anymore.

The three out of five year residency requirement is therefore NOT tied to your PR card validity. Instead, any time you cross the border and any time you apply for anything to CIC, they might check if on that very day you were in Canada for two out of the last five years.

PR Card is not the same as PR status. That is a common misconception. The expiry date on your card does not imply that your status is safe until then. At the same time an expired PR card does not imply that you are not a PR anymore.
