Hello,

Here is my situation ( I am an October CEC applicant) ...my current closed WP getting expired by end of April...and I just applied for my BOWP (online). My visa on my passport is expired. At this point, Can I go to my home country on a vacation and come back by mid April? ( before my current WP expiration) . If so, where should I get my TRV Visa for my reentry. Last time when my closed WP was extended, my lawyer told my extension gets voided if I go out of the country While the application is in process. Is that true in this case as well? Please advice.

First, if you are in Canada, you get a new TRV from Ottawa. http://www.cic.gc.ca/english/information/offices/canada/ottawa.asp. Otherwise, you need to get one from a visa office abroad (e.g., in your home country) - check processing times, as that can be months in some cases.

Second, I think you probably didn't exactly understand what your lawyer said. If you are on implied status, your implied status expires at the time you leave Canada. There is an exception for trips to Saint Pierre and Miquelon or the US, however, but that doesn't sound like it applies to your situation. As long as your current work permit has not expired, your pending application is not voided because you are not on implied status. If you are outside Canada when your work permit expires, however, you will no longer have implied status. You would either need to wait until a decision is made or you would have to re-enter Canada on visitor status until they make a decision on your application.

Good luck!

Thanks, This looks good explanation.

Can I apply TRV within Canada when I am in implied status? Or do I have to wait for my new WP?

My understanding is you need to have the work permit, but I'm certainly no expert in this area.

To apply TRV within Canada you need a valid Work permit or Study permit.
I think you can apply, but you will get a TRV that is valid until April (expiry of your current work permit).
