Hello,

I need suggestions.

(I hope I am asking relative questions)

I and my wife are planning to move to Canada and we are thinking about applying for a PR card ASAP.
I am an engineer and I have a 7+ years of experience from academic & software industry. I am in India.

My wife is pursuing her Masters in CS from Ca, USA and currently she is into her last semester. She also has B.Tech and MBA degrees from India. She has 7 months of working experience from India.

I was denied a student visa twice by the US consulate.

Now we are planning to move to Canada but we are not sure how to go about for the Canadian PR.

Is there something like Principal applicant and a Dependent applicant? If so,who has better chances between us for being a Principal applicant ?

Do both of us need to take the IELTS?

Can we take IELTS from different countries for same application?

While applying from any country, is it necessary that the spouse must be in the same country?

Is it better/allowed to apply from different countries or we should apply from only India or only US?

If you think this as a unique case, do you suggest us to hire an immigration lawyer? Can you give us some references of the lawyers?

Thank you in advance.

Your situation is pretty standard. There are plenty of people on this forum who have applied while spouses were living in different countries. It's not at all unusual and doesn't make any real difference to the process. Whether you use a lawyer or not is really up to you.

Based on the questions you are asking, it sounds like you haven't really done much research about the Express Entry program. I would recommend you first spend time researching to understand how the program works. Details here:

Who should be the primary applicant will depend on which one of you has the most points. You'll need to calculate your points to determine this. At least one of you, possibly both, will need to take IELTS. You can do this anywhere in the world.
