Good morning,

Trying to find a direction to go with this.

I'm a Canadian citizen, my wife is east Afican, we married last year after living together nearly 2 years.

We applied for her spousal this past February, her 2 kids are back home currently and I'd like to know the best way possible to bring them here to stay and live they are both under 18.

Thank you

George

I'm assuming her children were included in the PR application as your wife's dependents and as accompanying dependents. If so, they will be issued PR visas and will be able to move to Canada once her application is approved.

If you are looking to bring them to Canada before their PR has been approved, then they would have to try applying for a TRV (tourist visa). However this would only allow them to come to Canada temporarily and it might be challenging to get a TRV approved (but you can certainly try).

We did include them as dependents, but not as accompanying since my wife is already here has been for a couple years and they are still back home.
Including them as dependents on the Spousal is enough for visas? or is there something additional I need to do?

Would it just be a matter of trying to convince someone on their other side for the TRV? thanks

If you want them to come to Canada, then you must change them to accompanying dependents.

If you leave them as non-accompanying dependents, then they will NOT get a PR visa and will NOT be able to move to Canada as soon as your wife is approved for PR. In that case, you'll need to submit a new and separate application to sponsor them for PR (after your wife gets PR) which will take 8-12 months of additional time to process and will cost you more money.

Strongly recommend that you contact IRCC and change their status to accompanying. It doesn't matter that they are outside of Canada.

Wow, I am so glad I made a post.. is it easy enough for IRCC to change it to accompanying?

It should be as long as you aren't too far in the process. Send a case specific inquiry asap.
