My frd BOWP got rejected, can you appeal for the application

Hi there,

My frd is currently applying for express entry PNP program.
She was applying for BOWP due to the work permit expiring at the same time.
However her application got rejected saying the she did not provide the valid Provincial norminee certificate.
She had submitted the ON PNP nomination received online, but not sure why they reject her.

Can she appeal for the application?
Or she has to stop working and restore her status?

Please kindly advise.

First, she need to stop working from the day she got the rejection letter.

Second, Raise CSE and send OINP nomination with explanation letter, they might look into it.

Third, Order GCMS Notes ASAP.

Regarding appealing, I'm not sure wait for seniors or consult lawyer.

There is no Express Entry PNP program. Express Entry and PNP are different programs. Although you may get additional points in Express Entry for Province nomination, the only programs available under EE are FSWP, FSTP and CEC. Also it is not clear if she applied for BOWP before applying for PR or she already applied for PR and then applied for BOWP. In the first case she was correctly refused and there is no point to appeal.

Ontario Immigration has several immigration streams, only two of which can be used for Express Entry: Human Capital Priorities, and French-Speaking Skilled Worker. Is it possible she applied under one of the other streams? If so, then she will have to submit a traditional PR application (non-EE).

If her previous permit has expired, she must quit working. She can apply for restoration as a visitor, but unless she is eligible for a new work permit, there's no point in applying to restore as a worker. If she doesn't apply to restore, she must leave the country, unfortunately.

I'm currently on an open work permit that will expire in march 2017. I will (hopefully) soon receive an ITA through express entry.
If I have a PR application in progress, will i be eligible to apply for the BOWP?

Your friend should have waited for the ITA and submit all requirements. Whenever he gets his AOR then he'll be able to apply for BOWP. Nomination certificate will not suffice unless he have applied under EE- PNP stream.
That's most EE applicants under PNP stream doing in order to apply for BOWP and get approved.
