Hi I have received the following response from Sydney, NS 2 months back .

we have received your applicaion for permanent residence in canadain the federal skilled worker class.


The minister of citizenship, immigration and multiculturalism issued instructions which were published in the canada gazette on november 28, 2008. These instructions specify that only applicants who have an offer of arranged employment, applicants who are legally residing in canda for a least one year as a temporary foreign worker or an international student, or applicants who have work experience in certain listed occupations are eligible to be processed in the federal skilled worker class. we have reviewed your application under each of these criteria.

Although you have indicated that you are an international student, you have not been legally residing in cnada for at least one year. you have not indicated that you are legally residing in canda for at least one year as a temporary foreign worker nor have you indicated you have an offer of arranged employment. Your application has therefore been assessed on the basis of whether you have work experience in the list of occupations eligible for processing. These occupations are identified by codes and described in the National Occupational Classification (NOC). you may access the list of eligible occupations at:

you have indicated that you have work experience in an ocupation with the following NOC code:2174-programmer. This occupation is not included on the list of eligible occupations specified in the instructions identified by the Minister of Citizenship, Immigration and Multiculturalism and published in the canada gazette on 28 november 2008.



My question,

Now I have completed my 1 year stay as an international student as of August 2009. I have 2 year work experience before coming to canada as a programmer. Can i re-apply again by keeping the Code 2174.



Could experts please respond.

No brother, you can not reapply under same NOC, this will result in rejection again, your NOC should fall under 38 list which they have given, apply as per to their norms you will surely get success.

But if you look at their response...
when i applied last time i have not completed 1 year in canada(i am an international student studying in canada). Now i completed 1 year as a student in canada, as per my understading i can apply again because i have completed 1 year of stay also i have 2 years of preogramming experience before coming to canada. So i am planning to apply again with 0213..

Could someone please respond?.

If you stay here legally 1 year, you don't need to be in 38 occupations, but you need at least one year continuous work experience in type 0,A, or B.

I am also in 2174 code and waiting for Sydney.

You can apply again under category 3 as a person who has been studying and working in Canada for 12 months. You can apply under the same NOC.
 
You can apply under FSW Category 3, how many years experience do you have ? as you mentioned that you have only 2 years of experience.

This will reduce your points under experience so please calculate your points to see if you have a minimum of 67 or not.
