Hello mr Qorax

This is Kunal Jadeja from Dubai. We landed to Canada in 2011, January 24th. We stayed in Canada for 8 months. During that period we did not get job there so we had to go back to Dubai. So now we are in Dubai.

As I know I can stay outside Canada for three years out of 5 years from the day we landed in Canada.

I need your advice for below mentioned my queries:

1. My planning is to send my wife (she is the principle applicant) and kid to Canada before completion of three years and I want to stay in Dubai. So is it possible my wife can sponsor me from Canada?..

2. Does she need any source of income in Canada to sponsor me or not?.. If yes then how much income she requires

3 If i don't go back to Canada before completion of 3 years still i can enter to Canada? FYI My PR will be expiring on February, 2016.

A. If u want to succeed in Canada -- u need to stay here, face the initial challenges, work thru them, and soon u'd be what u deserve to be. Remember, we r a nation of immigrants, everyone here has faced the same music initially - and every one who persevered have 'made it'. So will u.

B. But if u procrastinate ur 'final' move -- u'd take that much longer to settle [here] -- u'd "need" to face the music anyway... thus sooner the better, 'coz the 'music' at a later age-bracket might not be that soothing... besides ur peers who 'landed' alongwith u & stayed-on would've moved further the ladder... which'd be a painful reality check for u, forever.

C. The above predicament mostly occurs with we Dubaians... our 'Dirhams' actually play a spoil-sport in our life. We tend to forget that those Dirhams were a temporary phase... MENA was just a 'platform', it never was our 'home'... would/could never be... we'd remain an expatriate (there) always -- whereas, our Canadian PR actually offers us a 'home'... to build our life on firm-footage.

Those were my 2-cents (or 3), for u.

Now to ur questions:

1. Yes, as u'd definitely lose ur PR ur spouse could 'sponsor' u. But that'd take time, efforts & money. And it'd be a 'wasted' chance... but plausible. And ur previous loss of PR makes no difference to ur 'new' spousal application. It'd be seen on it's own merits.

2. Yes, she needs to. Must have a sort of financial stability... usually a yrs' work experience here [having regular remunerations put into the bank]. IRPA is surprisingly quiet on the financial explanations, so no one can actually opine on the outcome of such spousal apps... but if she is closer to the LICO -- u'd be thru.

3. In most cases a BSO at the POE will let-u-in, even if u r out of status, to face an Immigr. Judge, to explain ur circumstances within 30-days. But if u r contravening the mandatory residential requirement - it'd be pretty tough for u to move the judgement towards urself.
