Hi there. I'm a PR card holder (Provincial Nominee-Manitoba). I lived in winnipeg for 7 months. Me and my family got a part time job working on a very little hours per week. We exerted too much effort but still failed to get a full time job during our entire stay of 7 months. We only have very little earnings to sustain our needs, rents and bills. We decided to move to Toronto to find a better job.

We informed our sponsor about our plan of moving out but she refused. But since we find it hard to live in winnipeg, we went to Toronto. Now, our sponsor is threathening us that she will make an action againts us if we will not return to winnipeg in two weeks time, she will go to the Nominee Program and tell them all the things that we did to her. She will do everything just to get-even with us.

1. Can our sponsor charge us? What case can she filed against us?
2. Will Manitoba gov't run after us?
3. Our sponsor is harrassing us, leaving all those unpleasant words over the telephone's voice mail, can we sue her? What ground?

We have no intention of misleading the Manitoba PNP but our living condition there is not good, we make extra effort to find a better job but we always failed.

Thank you.

1. Anybody can sue anybody over anything but she can not show any monetary damages because of your actions so how could she be awarded anything for that? The court can not force you to move back to Manitoba. I don't think you have to worry about that.

2. You should phone the Manitoba PNP yourself and ask them if this is a problem. With 7 months in Manitoba and real attempts at finding a job, I don't think they can do anything to you. You signed a form stating that you intend to settle in Manitoba and you really tried but I do not see how they can expect you to live there forever if you can not find a good job. You did not sign anything stating that you would live in Manitoba for a certain number of years.
If Manitoba PNP tells you that you must move back immediately or they will report you for misrepresentation and try to get your PR revoked, then you must either move back until you can get citizenship or take your chances with an immigration lawyer but frankly I think it is very unlikely that they will do that. It is very hard for them to prove that you did not have intentions to settle in Manitoba when you have shown that you lived and worked there for 7 months and did not succeed in finding a full time job.

3. Your sponsor is now mad because you moving out of Manitoba will stop her from sponsoring anybody else under the Manitoba program and that is understandable. She may want to sponsor her family members and now she can not. However, there is nothing you can do about that. You can tell her that if she doesn't stop harrassing you, you will take action against her for harrassment. Keep all the voicemail messages she leaves you. If she doesn't stop, you can try going to the police but unless she is threatening you with something criminal, bodily harm, death etc., then they may tell you it is a civil case. If they will not do anything, you can talk to a lawyer about it. You could also complain about her to the phone company she has her phone with. Play them the voicemails and they may tell her to stop calling you or threaten to cancel her phone if she doesn't.

Did you at least find a better job in Toronto? If you have a good job in Toronto, that would support your decision to leave Manitoba.

In a matter of days, we were able to get a better job. Thank you very much. You're a big help.

Hi ayen,

I just want to ask how are you right now?do you think you made the right decision to move? Were you given by toronto a health benefit same as what you were getting from manitoba? I am also planning to move to another state because i couldn't find a better job. Im working full time but minimum wage and been trying to apply for other jobs but no luck. Did u phone manitoba immigration about your moving?
