I worked in Canada for almost 12 years, from caregiver, unfortunately didn't get the PR because of non comply of my ex husband and the application was refused. I found an employer to sponsor me to work in a hotel as a room attendant and my work permit expired in May 2014, in between I applied under AINP in Alberta, the application was closed because when they finally open my application I was out of status. I've waited until I gave birth in Oct 2014 and decided to come home in February of 2015. In my almost 12 years in Canada, I have 2 Canadian children.

My question is, can i use my canadian kids to go back to canada or is there anyway i can go back???? :'(

Thanks in advance.

No - you can't use your Canadian kids to get back to Canada. If you want to return, you will have to qualify on your own. There are no benefits to having minor Canadian children.

Once your children are adults - and have lived and worked in Canada for a number of years - they may qualify to sponsor you for PR. However while they are children, there's nothing. If it was that easy, people would simply have kids while in Canada so that they can stay here.

Is there any ways I can go back though, considering I have been in Canada for number of years? Can I apply under Humanitarian and Compassionate Ground while outside Canada?

What would the grounds be though to apply ? Are your children living without you in Canada which I assume unlikely given ages.

H&C are for very specific cases for people with dire circumstances and rarely approved so unlikely just because your children are Canadian or your work record to succeed I would have thought.

I have 2 Canadian kids, ages 10 and 2 years old. Currently they live with my parents in my country (Philippines) as i am away working in another country and still trying to find ways to go back in Canada.

Is there anymore ways to get back in Canada? or should i start from scratch?

Your children living with family in the Philippines is not H&C reason for you to be allowed to work in Canada, no.

Agreed. You also cannot apply for H&C from outside of Canada.

If you wish to immigrate to Canada, you'll have to qualify through one of Canada's economic immigration streams just like anyone else.
