Well, the OP's lawyer friend actually was right about the dependents section, but the lawyer failed to mention them to fill the IMM5406, which is a complete different animal than the dependent section on IMM0008. Anyway, I bet the OP is an US citizen, and should be qualified for FBI channeler services, which it only takes 2-3 weeks to obtain a new FBI Rap sheet.

I really is very appreciated!! I got a new fingerprint cards today one in my old name and one in my married name... An agent at the FBI recommended I submit both for background check just in case.... . If I can find out if I qualify and can use a channeler service that would really cut down potential wait time!! We ain't spring chickens both of us in our 60's and just want to spend our last year's together enjoying life and holding hands by the ocean on Vancouver island

You don't have to have it re-done. Your current PCC is still valid for several months. The name change isn't an issue and you don't need a new one just for that.
 
Don't worry so much about the FBI background check. It hasn't been that long and as others have mentioned, yours is still good. My American husband got his in the spring of 2016 and we filed the following December. We didn't have any problems.
