Tonight after seeing a post about the update this February to form IMM 008, it made me decide to pull our file out to see check. Well it turns out not so good. The IMM 008 that our lawyer submitted is from 06-2014. Then after this discovery I checked the rest of the forms and seen that also IMM 5490 was revised in September 2014 is current and submitted August 2014.
So I am sure this is going to cause issues with our application. Both of these forms require my wives signature. And then the point of both police records expiring meanwhile.
Has anyone else been in this situation? If so does this mean an automatic re start or do we have been given a UCI number that we have the chance to re submit these mistakes? I'm curious to what our lawyer will have to say to this discovery.

Some people get lucky and have the application put on hold while they request new forms, while others have the whole thing returned to them.

The fact that you submitted the June version of 0008 is where I would be worried. They updated it in August, around August 8th I think it was, and even people who applied on August 1st had their applications returned. That form has been updated 3 times since the one you submitted, so that's not exactly a good job by your lawyer.

Hope they only ask you to update your forms.
Otherwise they'll send back your whole application.

What a lazy lawyer! You submitted your application in December and he had you using papers that were updated months before that. Guaranteed he/she just had the files saved and printed more when a new client came around. Didn't even take a look to see if the papers were updated. These half assed lawyers and consultants make me so mad! And there are so many of them!

As the others have said, that is a pretty stupid mistake for your lawyer to make. I would ditch him/her now.

I can only hope that CIC will hold our application and not return it to us. Today I've been waiting for a return call from the lawyer. My wife has now printed off the up to date forms and will fillout. We will wait for the instructions from CIC before we submit anything at this point. It's a super frustrating time for my wife and me to find this out.

Well I had just got of the phone with my lawyer. She had assured me that my file was sent to CIC being current and the application I was given from the lawyer was only a draft copy. I'm still skeptical until there's progress with CIC.

do you they keep copies of your complete application before you submitted? I would personally check those to ensure they are telling you truth. I wouldn't worry too much and wait until you hear back from CIC.

Yes the lawyer does have a final copy. She said she will check but is confident in what was sent. Also was told if I don't receive a email or phone call this coming Monday that it's a current at the date sent application.....fingers crossed!!

I thought the VO would be checking for content of the application IE if you used the correct form and Mississauga was just for evaluating whether the sponsor is able to sponsor the principal applicant?

No Mississauga checks all the application . I thought the same thing until i ordered my notes . If any of the forms aren't correct Mississauga will ask for new ones .

I'm assuming you signed your own paperwork, so you should know what you signed. Of course a lawyer is going to cover their arse. I've learned from this forum, one thing is not to trust in these lawyers too much. Everything you need is right here and there is no need for a lawyer, unless you run into a real issue.

I would have her email you across all the PDF files on what she submitted, the ones with your signatures on them. I'm surprised you don't have your own copies.

I have a question as now it gets closer to our AOR date. We filed the IMM 5476 Use Of A Representative. Now with this I ask is that will myself as the sponsor receive the updates in a email that I included in my info section of the application? Or because of the IMM 5476 all updates/progress is notified only to the lawyer.

Thanks in advance to any insight!

The above is what I had posted in another thread. Is there rights we still have to be able to look into our file via CIC or with this form they are lost?

When you have a representative, everything is usually sent to them. You definitely still have the right to look into your file. You can also rescind permission for your lawyer to be your representative. http://www.cic.gc.ca/english/information/representative/rep-who.asp

At this point of it all I guess we'll hold our breathe and hope for the best! Anxiety is off the charts for us both to know what is the situation of the application.
