Hello,

An applicant was approved for their Canadian Permanent Resident status in 2020 by way of an outland family class sponsorship. The marriage broke down between the sponsor and applicant within 10 months of their arrival to Canada.

There have been several concerning issues raised, two being 1) The applicant provided false information about employment, member organizations, length of time at their various different residences in their IMM 5669 E form and 2) an affidavit confirming a genuine relationship was signed by the applicant's family member who has a severe memory disorder and does not speak English, therefore, said family member would not have known what they actually signed.

There are several others, but these are the most glaring.

Does this constitute a misrepresentation?

Certainly neither of those things are good and are probably misrepresentation to some degree in my opinion.

Are you asking because you're the sponsor and want to get your ex's PR revoked? It's quite hard to do that after it's been granted.

Yes. We are seeking to get this person's PR status revoked. Right now, the conclusion points to a marriage of convenience and all of these components are part of the case the sponsor is trying to build.

There are also domestic abuse charges, claiming welfare, not doing taxes, working under the table. When writing these out, these things, unfortunately, seem very common.

I think we will submit a claim.

Do submit a cliam but also unless that spouse case is found gulity of immigration fraud, the sponsor is supposed to pay back any welfare/social assistance that's being cliam. The spouse is still on sponsor's undertaking for 3 years after he/she landed.
