Hello,

I have a question. I have a Canadian common law partner - we have been together for about 4 years. We have a lease doc + joint bank account, but we are doing taxes separately.

I said that I am in a common law relationship in my previous visa applications, howeverwhen I entered express entry profile, my advisors told me that it is okay to apply as single as my partner is canadian and he wouldn't affect my score.

I got ITA early March and I submitted all my EE docs in late April.

Now I got a request from CIC for an additional document, requiring to submit common law declaration form even though I submitted my application as single.

I am assuming they had a record of my precious applications.

Would this affect my express entry process? I am worried that this might show as a misrepresentation, however I said that I was single because he is candian and will not be part of my application + we do not do taxes together.

Please advise

Yeah, they probably looked at your history of previous applications. I kind of had a similar case, my previous applications had a representative, and when I got an ITA, I dropped my representative, but I got a request for a Use of Representative form anyway. So I submitted the form, where I cancelled the previous representative and included a letter of explanation that I used their services before but not presently.

IMO, go ahead and fill up the form, and include a letter of explanation that you did not include your partner as accompanying because they are Canadian + include a copy of their passport or any other citizenship proof.
