My partner's Visitor status expires July 29; We are considering marrying and applying for Spousal Sponsorship from Within Canada.

Is there a minimum period of time between applying for spousal sponsorship and current visitor status expiry?

If we apply by July 28, is my partner granted Implied Status for the period of time afterward in which we wait for Approval?

Furthermore, we want to apply for an Open Work Permit so my partner may work during the time we wait for Approval. I assume we must wait for an approval on the work permit before my partner may begin working; however, does Implied Status also grant freedom to work if the open work permit application is included with the Spousal Sponsorship Application?
 
You should apply a few days before you partner's status in Canada expires to make sure the application reaches CIC before your partner's visa in Canada ends. If you apply inland and include an open work permit with the application, your partner will have implied status in Canada. Implied status will not allow your partner to work - all implied status does is allow your partner to remain as a visitor in Canada legally. Your partner will have to wait until the work permit is approved before working will be possible. This will take around four months.
 
There is defined time period - it may however look like a marriage of convenience to immigration officers. My husband landed here on a vv on dec 25 and we wrre married feb 4. This was not his first trip to canada. We just extended his vv - inland wasnt an option for us. God forbid something happen and he needs to go home. We dont want to risk him being turned away upon returning and have our application cancelled.

Your partner will not have implied status unless you apply for an open work permit or a visitor visa extension. They CANNOT work without a permit. They must have the permit in order to work

I suggest that you start looking at the application. There is a LOT of information required and lots of effort needed. It took us about 4 months to have everytging ready to go. We needed translations too which can take some time. If your partner has kids they need to provide copies of their passports and birth certificates, photos, etc

Start there and maybe thibk of extending the visitor visa first.
