Hi,

I am the accompanying applicant with my wife, and i was diagnosed with Multiple Sclerosis 5 years ago.

my condition is stable with no relapses, and i am currently on medication.

Is there any hope in applying to Canada skilled worker Express Entry ? or is my family going to be rejected because of my condition ?

I am unclear if MS is considered "any serious disease or physical or mental disorder? "

Appreciate some insight

Yes MS is considered a serious disease. It's hard to say whether you will be rejected or not given the new rules. Definitely a possibility.

Your issue is the excessive demand test. if IRCC doctors feel your condition would cost Canada's healthcare and social system more than approx $20K per year, this would cause app to be rejected.

So to prepare for possible procedural fairness letter you might get, you should be getting doctor and specialists prognosis confirming your stable condition and cost of meds /treatments over the next 10 years.

You are going to be rejected if you are taking any disease modifying drugs and costs more than 19000 (the current threshold) a year.

If you can, do not immigrate to Canada. It is a very very long journal to fight the medical inadmissibility. Often take years and you are in a limbo.

Your partner's MS could prevent you both from becoming PRs. Too hard to anticipate who would and who wouldn't be accepted.

The rules are different for a temporary work visa as the threshold is much lower in this case, it is around $6500. The PR visa is unlikely to be an issue however because the limit is much more generous at around $20k.

Bear in mind these figures correspond to what the treatment would cost in Canada should you move over there and not what you currently pay in your country.

Cost of treating MS is quite high and there is a high risk that patients may not be able to work at one point so it may not be easy to get approval even for PR. Nobody can guarantee either way.

I agree about costs, this is why I put the dollar figures. However regarding work, the applicants with MS here in both cases are accompanying family members so there is no consideration given to their ability to work.

It's not about not being able to work there is a cost if people can claim disability.

Yes because there is no guarantee that you or your partner may lose your insurance. Drug manufacturer can stop patient assistance at any time. You can try and argue all these points if you get a procedural fairness letter. You may find that there are less patient assistance programs in Canada vs places like the US.
