Met with a consultant regarding sponsorship- conflicting info please help

On Tuesday we met with an immigration consultant. I am Canadian and my girlfriend is German. She is here on a WHV that is good until late February. We are considering getting married in the near future or we could do a common law sponsorship (as of late February 2016 we will have lived together for one year). The consulatant told us that in either case (marriage or common law sponsorship) we could apply for both inland and outland sponsorship at the same time. He said that with that route we could get the open work permit quicker for her with inland, but then she would be approved quicker for PR with the outland. From research on this forum people have said CIC would discard whichever sponsorship application comes in second?

He also told us that if we send in application for inland sponsorship with an open work permit application she could continue working after her WHV has expired on implied status until a decision is reached? We have read that this is not possible with a WHV because they are not extendable.

Please help. We need very clear and accurate answers right now. We are deciding which path to take. Thanks

You cannot send two difference applications inland and Outland at same time. You have to choose one or the other.

The WHV is not extendable, thus cannot work beyond the expired date. You would get implied status but only as a visitor, until the OWP is issued.

Is there any particular reason why you want to apply inland. It is one of the longest processing time. Your application would go a lot faster if you applied Outland. You can apply Outland while living in Canada. Your girlfriend must maintain her status in Canada.

Yes the reason is that with the inland application she would get the OWP within a few months when they approve me as a sponsor. We realize that she would be approved with outland quicker but would have to stop working until her PR is approved. She does not want to stop working as she has a good job that she likes and does not want to loose it. Also with the Refugee crisis in Europe it seems like their offices may slow down a bit more.

She has to stop working when her WHV is expired and get back to work with open work permit.
but OWP would be expired before she gets her PR and OWP is not extendable, too.

So her current/future employer have to apply for LMIA (it takes time and money for employer) then she can apply for new work permit

In other words, she has to find employer who has already LMIA or willing to do for her before her OWP is expired.

If your girlfriend wants to continue working past the expiry of her WHV, she must have a new and approved work permit in hand before her WHV expires. If you only qualify for common law in February, she won't meet this requirement and will have to stop working while she waits for the open work permit to be approved.

And as discussed now with you several times, you can't submit an inland and outland sponsorship application at the same time.

Please ditch your consultant.

I second that! Hope you don't have to pay for that consultant's advice. I find that this forum and also CIC website is enough to get all the information that I need when I sent my application before. I think that she can get PR faster if apply outland...the only downside is that she's in Canada as a visitor so cannot work. The plus side is that she can be with you. If you read the inland thread, you'll see that it took a long time to get PR compare outland. Maybe you can read vienna thread here :

When I applied in Dec 2014, some of the people from visa exempt country that were staying in Canada while applying outland, got Mississauga visa office handling their case. They got their PR way faster between 3-5 months. If your case is straight forward and no red flags then I don't think that you have to worry about anything.
