CIC also orders a background check from CSIS. They will do further investigation into your background BEYOND what shows up (or does not show up) in your PCC.
How much time it will take sir?

As i have sent my medical on 10th of Aug and i am still waiting for the reply.
They have also asked me to send my email address along with the documents.
I have also done the same, so will i first receive any email from there end and they will let me know if they need any other documents or they will let me know that they have dispatched the passport.

Like Why they have asked for the email address?

Sadly, there is no specific time for CSIS and CIC to finish your application. I've heard of this taking a few weeks to a few years. Sorry there's nothing definite here. :(

I have sent my passport along with the medical documents as it was mentioned in the letter that i have received for the medical and i have seen some of the cases were the passport was requested after medical is done. So i think from last few months they ask for the passport along with the medical, Correct?

It's really up to the visa officer's discretion. Personally, I'd be very unhappy about sending my passport to a visa office for months on end, since I travel extensively for my work and my passport is required for that travel.

Hopefully they will return it to you soon.

Good luck!

They have your passport. So you either have a COPR (and visa if required) or you have a rejection. Sadly, you have to wait until you get the letter to find out.

Here is the definition of a valid marriage from the CIC website:

You are a spouse if you are married to your sponsor and your marriage is legally valid.

If you were married in Canada:

You must have a marriage certificate issued by the province or territory where the marriage took place.

If you were married outside Canada:

The marriage must be valid under the law of the country where it took place and under Canadian law.
A marriage performed in an embassy or consulate must comply with the law of the country where it took place, not the country of nationality of the embassy or consulate.
So as long as the marriage is legally valid in India and not contrary to Canadian law, you may sponsor your spouse.

One thing to note: if you are married before you land, you must return the visa and request that they add your new wife to your application. Failure to do so will exclude her from the family class and this will mean that you cannot sponsor her as your spouse.

If you are married after you land, then you may sponsor your new wife (but as a PR you must be living in Canada to sponsor her, so unless she can come to Canada on a TRV she must wait until PR is granted.)

Hi Computergeek,

any idea how long it will take CPP to start processing my file. Following are my timeline:

Application received by CIC on 8th April, 2011
They sent me email with EAC no. on 11th May, 2011.
Since June 2011 my online E-Case shows RBVO.(Buffalo)
Since then no update. I appliied for CAIPS notes. will receive in 2 weeks from now.
Hopefully will get some idea from CAIPS notes.

Even i don't know if my file is transfered to CPP or some where else in US.

Will appreciate any predictions.

Thanks,
Andy

The closure of Buffalo has thrown everything out of whack, which makes predicting the outcome a difficult thing to do. Normally, I would have expected you to hear in May 2011, but that's exactly when Buffalo's closure was announced and the files were transferred en masse to Ottawa. My understanding is that everyone at the Buffalo office is now officially gone (it was open for a couple of months after the end of May date to allow them to shut everything down.)

Prior to its closure, Buffalo's processing time for FSW applications was 21 months for the first 20% of applications, 24 months for 50% of application, and 28 months for 80% of applications. The published times for NYC, Seattle, LA and Detroit are in line with these figures as well. Thus, I'd say you should be hearing something fairly soon (e.g., 18 months into the process is about the time they start asking you for docs - medicals, RPRF, updated PCC, etc) because you have a selection decision. With the Buffalo closure and corresponding delay, you may have to wait until early next year before you hear anything.

Good luck!

Oh, I know how painful it is to wait for CIC - I submitted my first application in June 2009 and that's still making its way through the process.

It won't matter where you are located. Just make sure you update CIC with your mailing address.
