hi, as i understand, as long as he or she has a valid status in canada and meet the minimum requirements can apply for CEC. for instance, you quit from your job or you were terminated but your work permit still valid. but if you don't have a valid status, i don't think you can apply. but i suggest, don't gamble on it. it would still be better to have a valid work permit.

You will be eligible to apply for permanent residency under CEC program ONLY if Your answer is yes to one of the following questions.

1) Do you have 2 years of skilled work experience as a temporary foreign worker in Canada?

2) Did you graduate from university or college in Canada AND do you have 1 year skilled work experience under post-graduate work permit in Canada?

There are more requirements then these two to qualify under CEC, but if your answers are No to both, sorry, CEC is not for you.

If you answered Yes to one of the questions, please go to the following link for more requirements.
