Hello, good day! I’m looking at several pathways for immigration to Canada. I am looking at Student pathway and hope to get a bit more information regarding PR.
I am married but separated. No children. There is no divorce in the Philippines and an annulment is costly and lengthy.
I do not intend to bring my spouse to Canada. I would also like to file for divorce in Canada once, God-willing, I become a naturalized Canadian citizen so I need not file an annulment in the Philippines. In this case, when I file for PR in Canada:
1) Would there be a legal document I could furnish to evidence separation (Affidavit of Separation with no intention of bringing my estranged spouse) or would I need to file a divorce in order to apply for PR. I am trying to only file a divorce once a Citizen (to avoid annulment proceedings) not as PR
2) Would a divorce in Canada allow me to drop my spouse’s last name (which I carry)?
3) As an option, I am looking at student pathway. Would this be an issue that I will not bring my estranged husband?
