Married after receiving PR visa

I have a question regarding sponsoring a spouse.

If a person was sponsored as a dependent child as part of a parent sponsorship. Then this person married a couple months after receiving a PR visa, but before landing in Canada. Now in Canada and working for one year. Can this person sponsor their spouse?

Was it necessary to inform CIC of the change of marital status even after receiving the PR visa?

You are not actually considered a PR until you have landed. You do not have any sort of "PR visa" prior to that. The document you're speaking of is a COPR and it does not actually mean anything for your PR status until you use it to land.

By landing as a sponsored dependent when they were actually married, this person committed misrepresentation. Not only will they never be able to sponsor their spouse, they also could be at risk of losing their own PR status if IRCC were to discover that they were married when they landed (because you are not eligible to be sponsored as a dependent if you are married).

Because getting married prior to landing would make them ineligible for PR, the proper steps for this person to have taken would be to land first and then get married afterwards. Too late for that now unfortunately.

Yes - it was necessary to inform CIC of the marriage. By failing to do so, you've committed misrepresentation and obtained PR status fraudulently. It's possible your PR status (or eve citizenship) could be revoked at some point in the future if CIC finds out about the misrepresentation.

No - you can never sponsor your spouse.

The question should really be that is that person changed his/her material status before he/she landed? If he/she landed as a single, but the matter of fact that he/she actually is married, then forget about the spousal sponsorship, he/she should worry about his/her own PR status, because of committing misrepresentation, when he/she landed in Canada.

As soon as this person got married, they immediately ceased to be a dependent on their parents PR app and should have been removed entirely from the application. They did not qualify to land as a PR.

As mentioned, this is serious misrepresentation and as a result they can most likely never sponsor their spouse, and will always need to fear having their own PR status revoked at any time if IRCC finds out about it in the future.
